  • Proof of Payment: Bank account statements reflecting digital payments/UPI transfers matching the rental receipts.

5. Section 194-IB: Tax Deduction at Source (TDS) on High Rent

If an individual or HUF pays rent exceeding ₹50,000 per month (or part of a month), they are legally obligated to deduct TDS under Section 194-IB. Following amendments in recent Finance Acts, the TDS rate under Section 194-IB stands at 2% (reduced from 5%).

  • The tenant must deduct TDS once a year (usually in March or during the last month of tenancy).
  • The tenant does not need a TAN (Tax Deduction Account Number); TDS can be deposited using their own PAN via Form 26QC.
